HAWAII COFFEE ASSOCIATION PRIVACY POLICY

The Hawaii Coffee Association and its affiliates (collectively, “we” or “HCA”) have issued this privacy policy, which was last updated on September 7, 2021. HCA respects and is committed to protecting your privacy.

1. Types of Information Collected

The personal information we collect may include, without limitation, your full name, address, telephone number, e-mail address, location information, and IP address you use to connect to the Internet. In certain circumstances, we may also collect additional information including your birth date, age, gender, governmental identification numbers (such as social security number, employer identification number, or driver’s license number), and/or financial information, if and when necessary to comply with our own tax or other governmental recording requirements.

2. Purpose of use

We may use your information to provide products and services to you (or to someone else on your behalf), to improve our products and services, and to communicate with you about our products and services. We would like to send you information about our products and services, as well as those of our members and other information and events related to our organization’s mission and purpose. If you have agreed to receive marketing information, you may always opt out at a later date. You have the right at any time to request that we stop contacting you for marketing purposes.

We will not handle the personal information in our possession beyond the extent necessary for fulfilling its intended purpose of usage, except in the following cases:

1. In instances where you have granted your permission;
2. In instances where we are required to do so by a legal order;
3. If such information is required for the protection of a person’s life, body, or property, and your permission cannot readily be obtained; or
4. If it becomes necessary by legal ordinance to cooperate with a government agency, public authorities, or parties authorized by them, and, as determined by HCA in good faith, there is concern that seeking permission of the customer may hinder the execution of the relevant duties.

Before using personal information for any purpose other than those listed above, we will notify you to request your consent, and will not use your personal information for such other purpose unless you give your consent.

3. Appropriate Collection

Whether you submit your information to HCA is entirely up to you. If you decide not to submit your information, we may not be able to provide certain products or services to you. We will only collect your personal information by appropriate and fair methods. We may collect personal information directly from you from applications, forms, or communications we receive from you, or from other sources on your behalf, in connection with our provision of products or services to you. Like many websites, we may also collect browsing information from your Internet browser, computer, mobile device, or similar equipment. We do not knowingly collect information from children under the age of 13, and our websites are not intended to attract children.

4. Security and Retention of Information

We take measures to prevent leakage, loss or damage and other necessary and appropriate measures in order to safely manage personal information. We use a combination of third-party security technologies, procedures, and safeguards to protect from unauthorized access, use, and/or disclosure of personal information. We work hard to retain information related to you only as long as reasonably necessary for business and/or legal purposes. We are not responsible for the privacy practices of third parties, even if our website links to those third parties’ websites.

6. Providing Information to Third Parties

Apart from the aforementioned cases of use of personal information collected, we may also share this information with certain third parties as permitted by law, without first obtaining your authorization. For example, we may share your personal information with other parties authorized to receive the information in connection with services being provided to you (such as payment processing providers), and to other third-party contractors or service providers who provide services or perform other functions on our behalf. Our headquarters are located in the State of Hawaii. By providing us with your information, you consent to the transfer, processing, and storage of such information outside your country of residence.

7. Access and Correction

You have the right to request copies of your personal data. We may charge you a reasonable fee for this service. You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete information you believe is incomplete. You have the right to request that we erase your personal data, under certain conditions. You have the right to request that we restrict the processing of your personal data, under certain conditions. You have the right to object to our processing of your personal data, under certain conditions. You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions. To access your personal information in the possession of HCA, to correct any inaccuracies, or to make any of the other requests described above, please submit your request to us in writing to: Hawaii Coffee Association, P.O.
